Welcome to Bako Deals. These Terms and Conditions ("Terms") are a binding agreement between you and Frequency Broadcasting, Inc., which operates Bako Deals ("Bako Deals," "we," "us," or "our"). They govern your use of bakodeals.com, your account, and every deal, voucher, and gift certificate you purchase from us.
Read them carefully. By using the site or buying a deal, you agree to these Terms. If you do not agree, do not use the site.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to purchase from Bako Deals. Some deals carry higher age requirements, which will be stated on the deal page.
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at bakodeals@frequencybroadcasting.com if you believe your account has been accessed without authorization.
We may suspend or close an account that we reasonably believe has been used for fraud, resale in violation of these Terms, abuse of our staff or merchant partners, or repeated chargebacks.
2. What Bako Deals is
Bako Deals is a marketplace. We negotiate offers with local merchants and sell vouchers and gift certificates that you redeem directly with the merchant.
The merchant, not Bako Deals, provides the goods and services. We act as the merchant's marketing and sales agent for the certificate. The merchant is responsible for the quality, safety, legality, and delivery of everything it provides. We are responsible for issuing your certificate and for the customer service obligations described in these Terms and in our Refund and Cancellation Policy.
3. Deal listings, pricing, and value claims
Each deal page states the price, what the certificate is worth, what it includes, and any merchant restrictions. Where we state a regular or comparison price, that price is the merchant's ordinary selling price for the same goods or services as represented to us by the merchant.
Deals are offered in limited quantities and for limited periods. Availability is not guaranteed until your order is complete.
We try to keep listings accurate. If a deal is listed with a materially incorrect price, description, or availability, we may cancel the affected order and issue a full refund. We will notify you if this happens.
4. Orders and payment
Placing an order is an offer to buy. Your order is accepted when we send your order confirmation and deliver your certificate.
Payment is processed by our payment provider. We do not store your full payment card number. You represent that you are authorized to use the payment method you provide.
Applicable taxes are handled as required by law. Gift certificates are generally not taxed at the time of purchase; sales tax is collected by the merchant at the time you redeem, based on the full retail value of what you receive. For deals fulfilled by pickup at our offices, applicable California sales tax is calculated and collected at checkout and shown on your receipt.
5. Your certificate
Certificates are delivered digitally to the email address on your order, normally within minutes of purchase. Print it or show it on your phone at the merchant.
5.1 Paid value and promotional value
Every Bako Deals certificate has two components:
- Paid value is the amount you actually paid for the certificate.
- Promotional value is the additional amount above what you paid, if any.
Your paid value never expires. Consistent with California Civil Code Section 1749.5, the paid value of your certificate remains redeemable with the merchant indefinitely and is not subject to any expiration date.
Promotional value may expire. If a promotional value expiration date applies, it is printed on the deal page and on the certificate itself. After that date, the certificate remains redeemable for its paid value toward the merchant's goods or services at their regular prices.
Example: you pay $25 for a certificate with a $50 total value. The promotional value expiration date is December 31, 2026. Use it before that date and you get $50 of value. Use it after that date and you still get $25 of value, with no expiration.
5.2 No fees
We do not charge dormancy fees, inactivity fees, service fees, or maintenance fees on certificates.
5.3 Cash redemption
If the remaining value of your certificate falls below ten dollars, you may request that the merchant redeem the remaining balance in cash, as provided under California law.
5.4 Use and limits
- Unless the deal page says otherwise, a certificate is for one-time use. Present it in full at the time of redemption.
- Quantity limits per customer, per household, or per visit are stated on the deal page when they apply.
- Certificates may not be combined with other offers, coupons, or discounts unless expressly permitted.
- Certificates do not cover tax or gratuity unless expressly stated. Please tip on the full pre-discount value of your order.
- Certificates are void if copied, altered, forged, sold, or transferred for value.
5.5 Transfers and gifting
You may give a certificate to someone else as a gift. You may not resell, auction, barter, or trade certificates, and you may not offer them on any resale marketplace. Certificates obtained through resale are void.
5.6 Lost certificates
Certificates are tied to your account. If you lose your email, log in to view your orders or contact us and we will resend it.
5.7 Deals requiring pickup at our offices
Some offers are fulfilled in person rather than at a merchant location. These are labeled Pickup at Bako Deals on the deal page.
Where. Bako Deals, inside the Frequency Broadcasting offices, 3651 Pegasus Drive, Bakersfield, CA 93308.
When. Monday through Friday, 9:00 AM to 5:00 PM, excluding holidays. Some items require an appointment, which will be noted on the deal page and in your confirmation email.
What to bring. Your order confirmation, printed or on your phone, and a valid government issued photo ID that matches the name on the order.
Someone else picking up. You may authorize another person by emailing bakodeals@frequencybroadcasting.com before pickup with your order number and that person's full name. They must present their own photo ID.
Pickup window. Items must be picked up within 30 days of purchase unless the deal page states a different window. Event and dated items must be picked up by the date shown on the deal page.
Unclaimed items. We will send reminders before your window closes. If an item is not picked up within 60 days of purchase, we may return it to inventory. In that case we will issue you store credit for the amount you paid, valid for one year, unless the item was labeled final sale or was a dated or perishable item that could not be resold.
Age restricted pickup items. Where an item is age restricted, you must present valid photo ID at pickup showing you meet the requirement. We will not release the item otherwise and no refund is owed where ID is not produced.
Risk of loss. Title and risk of loss for pickup items pass to you when the item is handed over.
No shipping. Pickup items are not shipped unless the deal page expressly says otherwise.
6. Redemption and your relationship with the merchant
Reservations, appointments, blackout dates, and location restrictions are set by the merchant and stated on the deal page. Call ahead when a deal requires it.
If a merchant refuses to honor a valid, unexpired certificate, contact us at bakodeals@frequencybroadcasting.com. We will work with the merchant to resolve it. If we cannot obtain honor of your certificate, we will refund your paid value.
If a merchant ceases operations, contact us. Where the merchant is unable to honor outstanding certificates, we will provide a refund of paid value or a credit of equal value toward another Bako Deals offer, at your choice, for certificates purchased within the preceding twelve months.
Complaints about the quality of a merchant's goods or services should be raised with the merchant first. Tell us as well. We take merchant performance seriously and will remove partners who do not treat our customers well.
7. Refunds and cancellations
Refund, cancellation, and support terms are set out in our Refund and Cancellation Policy, which is part of these Terms.
8. Age restricted and regulated deals
Some deals involve age restricted or regulated goods and services. Where a deal is age restricted, you must meet the stated age requirement at the time of purchase and at the time of redemption, and the merchant may require valid photo identification. Merchants may refuse service in accordance with applicable law, including alcoholic beverage regulations, and no refund is owed where service is properly refused on those grounds.
9. Deal alerts and messaging
Signing up for deal alerts is optional and is governed by our Privacy Policy. Consent to receive marketing messages is not required to make a purchase.
10. Acceptable use
You agree not to:
- Use the site for any unlawful purpose or in violation of these Terms
- Purchase certificates for resale, or acquire quantities intended to circumvent stated limits
- Use bots, scrapers, or automated tools to access, monitor, or purchase from the site
- Attempt to gain unauthorized access to the site, other accounts, or our systems
- Interfere with the operation of the site, including through denial of service attempts or malicious code
- Copy, reproduce, or duplicate certificates or certificate codes
- Submit false, misleading, or fraudulent information, including fraudulent chargeback claims
- Harass, threaten, or abuse our staff or our merchant partners
11. Intellectual property
The Bako Deals name and logo, the site design, text, graphics, and all other content are owned by Frequency Broadcasting, Inc. or its licensors and are protected by copyright, trademark, and other laws.
Kelly 95.3, Groove 99.3, and KNZR 1560 AM and 97.7 FM are marks of Frequency Broadcasting, Inc. Merchant names and logos are the property of their respective owners and appear with permission for the purpose of promoting their offers.
You may view and print site content for your personal, non-commercial use. Any other use requires our prior written permission.
12. Copyright complaints
If you believe content on our site infringes your copyright, send a written notice to bakodeals@frequencybroadcasting.com or to the mailing address in Section 19 that includes: your contact information, identification of the copyrighted work, identification of the material you believe is infringing and its location on our site, a statement that you have a good faith belief the use is not authorized, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your signature.
13. Content you submit
If you submit reviews, photos, comments, or other content to us, you grant Frequency Broadcasting, Inc. a non-exclusive, royalty free, worldwide license to use, reproduce, display, and distribute that content in connection with Bako Deals and station promotion. You represent that you own or have the right to submit the content and that it does not violate anyone else's rights.
14. Third-party links
Our site links to merchant websites and other third-party services. We do not control them and are not responsible for their content, products, or practices.
15. Disclaimers
The site and our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the site will be uninterrupted, secure, or error free, or that defects will be corrected.
We make no warranty regarding the goods or services provided by merchants. Those are the merchant's responsibility.
Nothing in these Terms limits any warranty or right that cannot be excluded under California law.
16. Limitation of liability
To the fullest extent permitted by law, Frequency Broadcasting, Inc., its officers, employees, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your use of the site or any certificate.
Our total liability for any claim relating to a certificate will not exceed the amount you paid for that certificate. Our total liability for any other claim relating to the site will not exceed one hundred dollars.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Frequency Broadcasting, Inc. and its officers, employees, and affiliates from any claim, loss, liability, or expense, including reasonable attorneys' fees, arising from your misuse of the site, your violation of these Terms, or your violation of any law or the rights of a third party.
18. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.
Informal resolution first. Before filing any claim, you agree to contact us at bakodeals@frequencybroadcasting.com and give us 30 days to resolve the matter. Most issues are resolved quickly at this stage.
Venue. If informal resolution does not work, you and Frequency Broadcasting, Inc. agree that any dispute will be brought exclusively in the state or federal courts located in Kern County, California, and both parties consent to personal jurisdiction there. Either party may bring an individual claim in small claims court if it qualifies.
Nothing in this section prevents you from filing a complaint with a government agency or affects any right you have under the California Consumer Legal Remedies Act.
19. General
Changes to these Terms. We may update these Terms. We will revise the "Last updated" date and, for material changes, provide notice on the site or by email. Continued use after an update means you accept the revised Terms. The Terms in effect at the time of your purchase govern that purchase.
Severability. If any provision is found unenforceable, the rest remains in effect.
No waiver. Our failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms, together with the Privacy Policy, Refund and Cancellation Policy, and any terms stated on an individual deal page, form the entire agreement between you and us regarding Bako Deals.
